The Money Shepherd End User License Agreement (EULA)
Licensing
Part 1 The end user is allowed to use The Money Shepherd for personal use only. The end user may not sell, resell or distribute The Money Shepherd in any way, shape or form.
Part 2 The software developer always assumes ownership of The Money Shepherd. This includes the source code, all copies of The Money Shepherd, any documentation that is included with The Money Shepherd, any artwork that comes with The Money Shepherd, and any decision to change, update, distribute, sell or discontinue The Money Shepherd. The end user owns a license to use The Money Shepherd as well as the data that the end user enters into The Money Shepherd. The data that the end user owns is personal data that the end user enters into The Money Shepherd. This does not include settings that change the behavior or appearance of The Money Shepherd.
Part 3 The end user may not reverse-engineer, hack or modify The Money Shepherd in any way. In doing so, the EULA is voided and the end user looses all rights to use The Money Shepherd. The end user may also be prosecuted by the fullest extent of the law.
Warranties
Part 1 Although The Money Shepherd is a great product, the software developer does not offer any warranties of any kind for The Money Shepherd at the maximum extent permitted by law. The Money Shepherd given as-is, which the end user uses The Money Shepherd at their own risk. The software developer does not offer any refunds or reimbursements of any kind as permitted by law.
Part 2 The software developer does not assume any responsibility for any damage The Money Shepherd causes to computer hardware, computer software, or other equipment. This includes damage done by a glitch, incompatibility, conflicts with another program, security holes in The Money Shepherd, or if the software is altered in any way by a malicious user or program (such as a virus, worm or ad-ware), as well as other causes. The end user will not be issued any refund or any reimbursements of any kind as permitted by law.
Part 3 The software developer does not offer any warranty, refund or reimbursement for any glitch or downtime of The Money Shepherd. This includes any downtime caused by an update for The Money Shepherd, an update from a third party (such as Microsoft,) or a conflict with another program, as well as other causes.
Liability for User Data
Part 1 The Money Shepherd is used to create and manage personal financial data for the end user. The software developer is not responsible for the security, integrity or reliability for that data. The end user assumes full responsibility for any personal information that may be corrupt, lost or stolen to the fullest extent of the law.
Part 2 The Money Shepherd gives the end user a choice as to where the personal information is stored. The end user is responsible for securing and backing up that information. The software developer does not offer any refunds or reimbursements if the data is lost, corrupted or stolen to the fullest extent of the law.
Part 3 The software developer is not responsible for any miscalculations, errors or corruption The Money Shepherd may cause to the user data. This includes glitches, updates, modifications, platform incompatibilities or for any other reason.
Part 4 The end user should not enter information in The Money Shepherd that The Money Shepherd does not acquire. This includes, but is not limited to: social security numbers, bank account numbers, credit card numbers, birth-dates or any other information. Entering in any information that The Money Shepherd does not acquire may greatly increase the collateral damage that might be done to the end user if the personal information were stolen. The software developer does not offer any reimbursements or refunds under any circumstance to lost, stolen or corrupted data.
Miscellaneous
Laws Any interpretation or legal dispute shall be governed by the laws of Illinois. Woodford County (or the United States District Court for the District of Illinois if a federal case) shall have exclusive jurisdiction over any court hearings pertaining to The Money Shepherd or against the publisher.
EULA Updates and Modifications The software developer has the right to change or modify the EULA at any time for any reason. The most current version of the EULA overrides any other version or posting of the EULA. This includes the version of the EULA that is bundled with The Money Shepherd in any version. The most current version of the EULA will be posted on the software developers website. The most current version of the EULA has precedence over any other version regardless if the end user can access the most current version as to the fullest extent of the law. The most current version of the EULA has precedence over any other version even if it is not accessible, for any reason. This includes but is not limited to: The software developers website is down, the link to the EULA on the website is broken or the file for the EULA is corrupted. The EULA is voided if it is modified by any other third party or source that is not authorized by the software developer.
Other End User License Agreements This EULA does not override any other EULA that the end user has agreed to. This includes, but is not limited to, a EULA from a third party (such as Microsoft,) a EULA written for another technology (such as the software developers EULA for using the software developers website) or the EULA written for the media that The Money Shepherd is distributed (such as a CD, file or the end users Internet Service Provider.) The Money Shepherds EULA only pertains to the usage or distribution of The Money Shepherd as permitted by law. Any other EULA does not reduce or relax any limitations that are stated in The Money Shepherds EULA as permitted by law.
